Probity LTD, operating as Tribecast and having a registered address at Israel Zarhi 26/5, Jerusalem 9728090, Israel (“Tribecast”, “we”, “us”, “our”), respects the legitimate rights of copyright owners and has adopted the notice and takedown procedure described below. This policy follows the procedure set out in the United States Digital Millennium Copyright Act (DMCA). We apply the same procedure to copyright complaints from any country.

This policy should be read together with our Terms of Service and our Acceptable Use Policy.

Who can upload content to Tribecast

Tribecast does not offer public or self-service uploading, and there is no open signup. Every customer is onboarded by our team. We work only with rightsholders who hold exclusive master rights to the content they supply, and we verify those rights before an account is created.

Under our Terms of Service, every customer warrants that they own or are fully licensed for all content they upload, and indemnifies us against third party claims. Under our Acceptable Use Policy, uploading infringing material is prohibited. Content supplied by customers is additionally subject to review by our team and to automated content matching before it is distributed.

How to send a proper DMCA notice

The DMCA provides a legal procedure by which you can ask us to remove content that infringes your intellectual property rights. A proper notice tells us specific facts in a document signed under penalty of perjury.

Please note that you may be liable for damages, including costs and legal fees, if you materially misrepresent that material is infringing your copyright. If you are not sure whether you are the proper copyright holder, or whether copyright law protects your material, you may wish to consult a lawyer before sending a notice.

To write a proper notice, please provide all of the following:

1. Identify, with sufficient detail, the copyrighted work you believe has been infringed. If your notice covers several works, you may provide a list;
2. Identify the material that is claimed to be infringing and that you want removed or disabled, with information reasonably sufficient to permit us to locate it. A direct link is best;
3. Provide information reasonably sufficient to permit us to contact you, such as your name, address, telephone number and, if available, an email address;
4. Add the following statement: “I have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law”;
5. Add the following statement: “I swear, under penalty of perjury, that the information in this notification is accurate, and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed”;
6. Sign the document, physically or electronically; and
7. Send it to our designated agent at the address below.

If your notice is incomplete we may be unable to act on it, and we will tell you what is missing.

What we do when we receive a notice

1. We acknowledge your notice within two business days;
2. We review it to confirm it contains the required information;
3. If the notice is valid, we expeditiously remove or disable access to the reported material;
4. We notify the customer who supplied the material and send them a copy of your notice;
5. We tell you what action we have taken; and
6. We record the notice and its outcome.

We may remove or disable access to material while we review a notice.

How to submit a counter-notification

If your content was removed under the procedure described above and you believe the removal was improper, you may submit a counter-notification. You may be liable for damages, including costs and legal fees, if you materially misrepresent that material is not infringing. If you are unsure, we suggest you consult a lawyer first.

To write a proper counter-notification, please provide all of the following:

1. Identification of the material that has been removed or disabled, and the location at which it appeared before it was removed or disabled;
2. Your name, address and telephone number;
3. The following statement: “I consent to the jurisdiction of the courts set out in the Tribecast Terms of Service, and, where applicable, to the Federal District Court for the judicial district in which my address is located”;
4. The following statement: “I will accept service of process from the person who submitted the infringement notification or his/her agent”;
5. The following statement: “I swear, under penalty of perjury, that I have a good faith belief that the affected material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled”; and
6. Sign the document, physically or electronically.

Send your counter-notification to [email protected] with “Counter-Notice” in the subject line.

We forward counter-notifications to the party who sent the original complaint. We may restore the material between 10 and 14 business days after doing so, unless the complaining party notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.

Repeat infringers

We terminate the accounts of repeat infringers. An account that is the subject of three or more valid copyright notices which are not withdrawn or successfully countered will be terminated. We may terminate an account after fewer notices, or without notice, where the infringement is serious or deliberate.

To the extent permitted by law, termination for repeat infringement does not entitle the customer to a refund or service credit.

Linked third party channels

Many Tribecast customers operate linked channels on third party platforms such as YouTube. Those platforms operate their own copyright enforcement. If a customer streams unauthorized content, the platform may take the stream down and suspend their live streaming rights immediately, independently of any action we take.

About this policy

We reserve the right to modify this policy at any time by publishing the revised version on our website. The revised version will be effective from the earlier of the date the customer uses our Products after we publish it, or 30 days after we publish it.
